The Supreme Court has spent a marathon period of several hours yesterday July 4th 2012 listening to arguments from Lawyer Bu-Buakei Jabbi on behalf of P.C. Alhaji Alpha Madeseray Sheriff II and Lawyers L.M. Farmah and Osman Kanu on behalf of the National Electoral Commission and the State. The matter was heard before Supreme Court Judges headed by the Chief Justice of Sierra Leone Hon. Haja Hawa Umu Tejan-Jalloh. Jabbie is seeking several declarations and also compensations for his client and a restitution of his position as P.C.
The arguments are around whether it was legal for the P.C. to be removed in the manner in which he was removed following recommendations of the Justice Fofana Commission of Inquiry into administrative malpractices in Biriwa.
Bu-Buakei Jabbie and the defending lawyers are making their points around the legitimacy or otherwise of Fofana Commission of Inquiry in relation to the Provinces Act, the Chieftaincy Act and the Constitution of Sierra Leone.
