Magistrate Hannah Bonnie of the Freetown Magistrate Court No.3 at Siaka Steven Street in Freetown has on Wednesday April 12th, 2017 passed judgment in the matter that police charged to court against the two-accused persons, Abdul Ernest and Henry Mammy for the offence of prohibited use of public place to wit defecating in an unauthorized place in Freetown contrary to Regulation 41. G. of the Freetown City Council Bye –Laws of 2010.
Magistrate Hannah Bonnie in his judgment said in Court that the prosecution has given overwhelming evidence against the two-accused people, Abdul Ernest and Henry Mammy and she therefore sentence them to two-month imprisonment each or each pays a fine of five hundred thousand Leones to both the sub-treasury Department of the Judiciary and to the Freetown City Council. She found them guilty of toileting in the Samba Gutter which is a public gutter at Dundas Street in Freetown.
According to the particulars of offence in the indictment, the accused people, Abdul Ernest and Henry Mammy were arrested by a team of Freetown City Council Metropolitan Officer who on Tuesday April 4th, 2017 met the accused people defecating at Samba Gutter in Freetown.
The prosecutor is Police Constable 9155 Dwright Macarthy and the defense counsel for the accused people, Abdul Ernest and Henry Mammy is lawyer I.K. Kamara ESq.
